Terms of service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Dyst, including the website at https://dyst.bybear.dk and related APIs (the “Service”).

The Service is provided by Software By Bear (enkeltmandsvirksomhed), CVR no. 42094099, Thit Jensens Gade 4, 11, 8000 Aarhus C, Denmark (“Software By Bear”, “we”, “us”).

By creating an account or using the Service, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Service.

2. The Service

Dyst helps organisations record competitive match results and maintain derived skill ratings for team line-ups. The Service is for recording results and scores only. It is not a gambling, betting, wagering, or real-money staking platform, and we do not offer odds, payouts, or prize pools.

3. Eligibility

You must be at least 18 years old to use the Service. By using Dyst, you represent that you meet this requirement.

4. Accounts and sign-in

Access currently requires signing in with Google. You are responsible for the Google account you use and for activity that occurs under your Dyst session. Keep your Google credentials secure and tell us promptly if you believe your Dyst access has been compromised.

We may refuse, suspend, or terminate access where reasonably necessary to protect the Service, other users, or to enforce these Terms.

5. Organisations, permissions, and content

Within an organisation, the organisation owner — and anyone the owner grants relevant permissions to — is responsible for managing members, invitations, match recording, corrections/tombstones, and other organisation settings.

You agree that:

  • you will only invite people you are entitled to invite
  • match results and related data you submit will be entered in good faith
  • Software By Bear does not guarantee that user-entered results are accurate or complete
  • disputes about who won a match, who should be invited, or how an organisation is run are primarily for that organisation’s owner and permitted members to resolve

You retain rights in content you submit, but you grant Software By Bear a worldwide, non-exclusive licence to host, process, display, and derive ratings from that content as needed to operate the Service (including keeping anonymised match history after account deletion, as described in the Privacy policy).

6. Acceptable use

You agree not to:

  • use the Service for unlawful purposes
  • attempt to gain unauthorised access to accounts, data, or systems
  • interfere with or disrupt the Service, including by overloading or abusing APIs
  • misrepresent your identity or affiliation in a misleading way
  • upload malware or harmful content
  • scrape or harvest personal data of other users except as the product intentionally exposes it to you as a member
  • use the Service to facilitate gambling or real-money stakes

7. Ratings and calculations

Skill ratings are derived projections based on effective match history and our rating algorithm. Ratings may change when history is corrected or replayed. We do not warrant that ratings reflect real-world skill or are suitable for any particular decision outside casual competitive tracking.

8. Fees and future paid features

The Service is currently offered without charge for core usage. We may introduce paid licences or paid features later. If we do, pricing, billing terms, and any changes to free access will be communicated before you are charged. Unless we say otherwise, paid features are optional add-ons and these Terms continue to apply.

9. Availability — no uptime promise

The Service is provided on an “as is” and “as available” basis. We do not promise uninterrupted availability, any specific uptime percentage, or that the Service will be error-free. Maintenance, outages, data loss, delayed rating updates, or discontinuation of features may occur.

10. Disclaimer of warranties

To the fullest extent permitted by Danish law, Software By Bear disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.

Nothing in these Terms excludes mandatory consumer rights that cannot be waived under applicable law.

11. Limitation of liability

To the fullest extent permitted by law, Software By Bear is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of (or inability to use) the Service.

Our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) DKK 0 if you have paid us nothing in the 12 months before the claim, or (b) the amounts you paid us for the Service in those 12 months.

These limits do not apply to liability that cannot be limited under mandatory Danish law (for example, liability for intentional misconduct where such limitation is prohibited).

12. Account deletion

You may request deletion of your personal information as described in the Privacy policy. Anonymised match results and scores may remain so that ratings for other users stay consistent.

13. Changes to the Service or Terms

We may change or discontinue parts of the Service at any time. We may also update these Terms. The “Last updated” date will change when we do. Continued use after an update constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and request account deletion.

14. Governing law and venue

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. Courts of Denmark have exclusive jurisdiction, subject to any mandatory consumer protections that give you the right to bring proceedings in another venue.
